في ظل تصاعد التحديات البيئية العالمية، حيث تكشف تقارير الهيئة الحكومية الدولية المعنية بتغير
المناخ ) IPCC ( لعام 2023 عن ارتفاع متوسط درجة حرارة الأرض بمقدار 1.1 درجة مئوية، وتسجيل
مستويات قياسية لثاني أكسيد الكربون عند 417.9 جزء في المليون، تنظم جامعة الإخوة منتوري قسنطينة
1 كلية الحقوق ومخبر الدراسات والبحوث في المغرب والبحر الأبيض المتوسط، ملتقى وطنيا يجمع نخبة
من الباحثين والخبراء لبلورة رؤية متكاملة حول صناعة الدستور الأخضر.
الرؤية الاستراتيجية
يمثل الملتقى منصة علمية متخصصة تهدف إلى تأسيس مقاربة قانونية-دستورية متكاملة تتجاوز
المفهوم التقليدي للحماية البيئية. يستند هذا المسعى الى الاستفادة من تجارب الدول المتميزة لدول مثل فرنسا
( 2004 (، الإكوادور ) 2008 (، وجنوب إفريقيا ) 1996 (، إضافة إلى تحليل التطورات الدستورية في
المنطقة العربية، وخاصة التجربة الجزائرية من خلال تعديلات 2016 و 2020 .
الإشكالية المركزية
ينطلق الملتقى من إشكالية محورية تتمثل في: كيف يمكن للتأسيس الدستوري البيئي أن يشكل منظومة
قانونية متكاملة قادرة على: تجاوز محدودية التشريعات التقليدية، بناء آليات متكاملة للحماية والتكيف
المستمر، ضمان العدالة البيئية وحقوق الأجيال الحاضرة والمستقبلية، تحقيق التوازن بين متطلبات التنمية
الاقتصادية والحفاظ على الموارد الطبيعية
لذلك ركزت المحاور العلمية على ما يلي :

- التأصيل الدستوري للحقوق البيئية
- تطور مفهوم الدستور الأخضر في النظم الدستورية المعاصرة
- العلاقة بين الدستور الأخضر والتنمية المستدامة
2 -البعد الدولي والتكامل التشريعي:
- آليات التنسيق بين التشريعات الوطنية والاتفاقيات الدولية
- القيمة الدستورية للمعاهدات البيئية
- تجارب دولية رائدة في الدسترة البيئية
3 -الحوكمة والمؤسسات:
- دور المؤسسات الدستورية في السياسات البيئية

“Crafting the Green Constitution: A Future Vision for Achieving Sustainable Development”

Context and Significance
In light of escalating global environmental challenges, where the Intergovernmental Panel on Climate Change (IPCC) reports for 2023

reveal an increase in Earth's average temperature by 1.1 degrees Celsius, and record levels of carbon dioxide at 417.9 parts per million, the University of Brothers Mentouri Constantine 1's Faculty of Law and the Laboratory of Studies and Research in the Maghreb and Mediterranean region are organizing a national forum that brings together elite researchers and experts to develop an integrated vision on crafting the Green Constitution.
Strategic Vision
The forum represents a specialized scientific platform aimed at establishing an integrated legal-constitutional approach that transcends the traditional concept of environmental protection. This endeavor builds upon learning from distinguished national experiences, such as France (2004), Ecuador (2008), and South Africa (1996), in addition to analyzing constitutional developments in the Arab region, particularly the Algerian experience through the 2016 and 2020 amendments.
Central Problematic
The forum addresses a central problematic: How can environmental constitutional foundation establish an integrated legal system capable of: overcoming the limitations of traditional legislation, building comprehensive mechanisms for protection and continuous adaptation, ensuring environmental justice and the rights of present and future generations, and achieving balance between economic development requirements and natural resource preservation?
